Endstation Forensik: SystemsprengerInnen als blinder Fleck des Sozialsystems

Abstract

Im Beitrag wird eine Fallanalyse entwickelt, die sich mit der Situation einer Klientin der Erwachsenenvertretung beschäftigt. Aufgrund von Freiheitsberaubung einer Betreuerin in einer Wohneinrichtung der Kinder- und Jugendhilfe befindet sich die Klientin seit fünf Jahren in der forensischen Abteilung einer Psychiatrie. Auf Basis diverser zur Verfügung stehender Gutachten, Berichte und Dokumentationen, welche von HelferInnen verschiedenster Professionen erstellt wurden, und mit Rekurs auf zwei sozialdiagnostische Verfahren – der Netzwerkkarte und dem Biografischen Zeitbalken – werden Hypothesen aufgestellt und kasuistische Interpretationen präsentiert, damit ein Denken über das Gewohnte hinaus möglich wird.

Die Erkenntnisse, welche sich aus der akribischen Aufarbeitung im Zuge der Fallanalyse ergeben haben, weisen auf einen dringenden Veränderungsbedarf in Hinblick auf die Verwahrung und den allgemeinen Umgang mit der Klientin hin. Die Auseinandersetzung mit für den Fall relevanter Literatur, weist zudem ganz allgemein auf die Erfordernis einer Reformierung hin: in Bezug auf den Umgang mit „SystemsprengerInnen“ und fehlende Einrichtungen für junge, „abnorme“ RechtsbrecherInnen.

In this article, a case analysis is presented that deals with the situation of a client of adult legal representation. Due to the deprivation of liberty of a supervisor in a residential facility of child and youth welfare, the client has been in the forensic unit of a psychiatric hospital for five years. On the basis of various available surveys, protocols, and documentation, which were prepared by professionals of different backgrounds, and two social diagnostic procedures – the network map and the biographical time bar – hypotheses are formulated, and casuistic interpretations are presented, so that thinking beyond the conventional is possible.

The findings, which emerged from the meticulous processing in the course of the case analysis, point to an urgent need for change with regard to the custody and the general handling of the client. The examination of literature relevant to the case also indicates the need for reform in general: with regard to the treatment of so-called system busters and the lack of facilities for young, deviant lawbreakers.
